Personal Injury Compensation: What Can I Expect?
Personal injury compensation (or bodily injury compensation), whether from a car accident, truck accident, motorcycle accident or a slip & fall / trip & fall incident, is measured in two parts:
I. Special Damages, including:
1. current and future medical bills, including prescriptions.
2. lost income/wages.
3. cost of travel and parking for medical treatment.
Once you have completed current medical treatment, the bills and costs are totaled. If future medical treatment is necessary, an expert estimate of that future medical treatment will be calculated. The amount of lost income or wages and travel costs are also totaled separately.
II. General Damages, commonly known as pain and suffering.
For purposes of settling with an insurance company anytime before having a trial where a jury will decide what you will recover, general damages are traditionally calculated as a multiple of the medical bills as totaled above. It used to be that 4x medical bills was considered by the insurance company, but that number has become less and less over the years and caused more cased to be tried before a jury. For example, if you have $5000 in medical bills, you might make a demand for 3 x $5000 = $15,000 plus lost wages, and other miscellaneous related expenses. If the insurance company is unwilling to make an acceptable offer to settle, a judge or jury will have to decide what is the fair compensation for your injuries and damages.
If you were in an automobile, truck or motorcycle accident, you will also be entitled to recover for (1) the cost of repairs to that vehicle or market value if totaled; (2) the diminished value of the vehicle if repaired (in certain circumstances); and (3) the loss of use of the vehicle (measured as cost of renting a car while your vehicle is being repaired or replaced). These are known as property damages.
